Yes. The Song-Beverly Act provides that a vehicle out of service for repair for 30 or more cumulative calendar days during the warranty period is presumed to be a lemon. Each day the vehicle is at the dealership counts, including days waiting for parts. You should retain all repair orders documenting the dates your Terrain was in for service.
Can I pursue a Lemon Law claim if the dealer says the Terrain transmission issue is a normal characteristic?
A dealer stating that harsh shifting is a normal characteristic does not eliminate your rights under the Song-Beverly Act. If the condition substantially impairs the use, value, or safety of your Terrain, it may still constitute a nonconformity. You should document the dealer's response in writing and consider seeking an independent inspection to establish the defect.
Do I have to go back to the same dealer for every repair attempt on my Terrain to file a Lemon Law claim?
No. Under California law, you may take your vehicle to any authorized GMC dealership for warranty repairs. Each repair attempt at any authorized dealer counts toward the reasonable number of attempts required. Keeping copies of every repair order from each dealership you visit strengthens your claim.
What compensation am I entitled to if my GMC Terrain qualifies as a lemon in California?
Under the Song-Beverly Act, you are entitled to a full refund of the purchase price including taxes, registration fees, and incidental costs such as towing and rental vehicles, minus a reasonable mileage offset.
