My 2022 EV6 keeps dying because of the 12-volt battery drain issue and Kia has tried to fix it three times. Do I have a Lemon Law claim?

A vehicle that repeatedly fails to start due to a parasitic 12-volt battery drain is substantially impaired in its use and may also present a safety concern if it dies in traffic or a remote location. Three repair attempts for the same defect bring you close to the four-attempt presumption threshold under Song-Beverly, or may already meet the two-attempt safety defect threshold depending on the circumstances. Document every instance of being stranded and any emergency roadside assistance calls as evidence.

The fast charging on my EV6 fails at most DC stations and Kia blames the charging networks. Can I still pursue a Lemon Law claim?

If the EV6 fails to fast charge at multiple different charging stations and networks, the defect is almost certainly in the vehicle rather than the infrastructure. Under Song-Beverly, the manufacturer cannot avoid responsibility by blaming third-party equipment when the vehicle's own charge port control module is at fault. Document charging failures across different stations with photos, timestamps, and station IDs to demonstrate a pattern that points to the vehicle.

My EV6's battery has lost significant range within 20,000 miles. Kia says up to 30 percent degradation is within specification. Is that acceptable under California Lemon Law?

Kia's warranty specification for acceptable battery degradation does not override your rights under the Song-Beverly Consumer Warranty Act. If the range loss substantially impairs the vehicle's use or value compared to what was advertised and promised at the time of sale, it may qualify as a nonconformity. California courts consider whether the vehicle can perform as a reasonable consumer would expect, not simply whether it meets an arbitrarily set manufacturer threshold.

I purchased the EV6 with California's Clean Vehicle Rebate. If Kia buys back the car under Lemon Law, do I have to return the state rebate?

California's Clean Vehicle Rebate Project (CVRP) and the Song-Beverly Consumer Warranty Act operate independently. Generally, a Lemon Law buyback does not require you to return the CVRP rebate, as the rebate was earned at the time of purchase based on your qualifying purchase of a clean vehicle. However, consult with your Lemon Law attorney to confirm current CVRP program terms, as the rebate program's clawback provisions may change. The Lemon Law buyback amount itself is calculated based on the price you paid, not reduced by any state rebates received.
