Land Rover Defender Lemon Law FAQ
Can I file a California Lemon Law claim on my Defender if the transmission has a delayed engagement issue?
Yes, a transmission that hesitates or delays shifting from Park to Drive is a defect that impairs both the use and safety of your Defender, especially in traffic situations. Under the Song-Beverly Act, if the dealer has attempted to repair this condition multiple times without success, you may be entitled to a refund or replacement vehicle. The delayed engagement issue in the ZF 8-speed is well-documented and strengthens your case.
Does my Defender qualify as a lemon in California if the defect only happens intermittently?
Yes, intermittent defects are covered under the Song-Beverly Act as long as they substantially impair the use, value, or safety of the vehicle. The fact that a defect is difficult to replicate at the dealership does not bar your claim. Document every occurrence with dates, driving conditions, and any dashboard warning messages, and insist the dealer note the complaint on the repair order even if they cannot duplicate the symptom.
Is a used Defender still covered under California Lemon Law if it was purchased with remaining factory warranty?
Yes, the Song-Beverly Act applies to used vehicles that are sold with the balance of the manufacturer's original new-vehicle warranty still in effect. The key requirement is that the defect occurred and was reported during the active warranty period. Used vehicles purchased with a separate dealer warranty may also be covered, but the analysis differs from standard manufacturer warranty claims.
What happens to my Defender extended warranty if I get a California Lemon Law buyback?
If your Defender is repurchased under the Song-Beverly Act, the manufacturer must refund the cost of any extended warranty or service contract you purchased as part of the original transaction. This includes Land Rover Care prepaid maintenance plans and extended protection plans sold at the time of purchase. Any unused portion of a separately purchased extended warranty may also be refundable depending on the warranty provider's cancellation policy.
