No. The Song-Beverly Act does not impose a minimum or maximum vehicle purchase price. Whether your LX cost $90,000 or $130,000, you have the same Lemon Law protections as any other new vehicle buyer in California. The value of your claim will be based on the actual price you paid.

What damages can I recover under Song-Beverly for my defective Lexus LX?

Under the Song-Beverly Act, you can recover the full purchase price or lease payments, minus a mileage offset, plus incidental damages such as towing costs, rental car expenses, and repair costs. If the manufacturer willfully violated the Act, you may also be awarded a civil penalty of up to two times your actual damages.

Can Lexus refuse to buy back my LX if they say the turbo engine issue is software-related?

No. Whether the defect is hardware or software in nature does not affect your rights under the Song-Beverly Act. If the turbo engine issue in your LX substantially impairs the vehicle and cannot be permanently fixed after a reasonable number of attempts, it qualifies regardless of root cause.
