Lincoln Aviator Lemon Law FAQ
Is my Lincoln Aviator eligible for a California Lemon Law claim if the engine keeps stalling?
Yes. Engine stalling is considered a serious safety defect under the Song-Beverly Consumer Warranty Act. If your Aviator's 3.0L EcoBoost engine continues to stall after two or more repair attempts for the same defect, you likely have a strong Lemon Law claim. Safety-related defects require fewer repair attempts to qualify than non-safety issues.
Can I still pursue a Lemon Law claim if Lincoln issued a TSB but the fix did not resolve my Aviator's transmission problem?
Absolutely. A Technical Service Bulletin is an acknowledgment by the manufacturer that a known problem exists. If the TSB repair was performed but the transmission defect persists, this actually strengthens your Lemon Law claim because it demonstrates that the manufacturer was aware of the issue and still could not repair it within a reasonable number of attempts.
What compensation am I entitled to under California Lemon Law for my defective Lincoln Aviator?
Under the Song-Beverly Act, you are entitled to either a replacement vehicle of comparable value or a full refund of the purchase price, including taxes, registration fees, and monthly payments made. The manufacturer may deduct a reasonable mileage offset for the period before the first repair attempt. You are also entitled to have your attorney fees paid by the manufacturer.
Does the Song-Beverly Act cover my Aviator's panoramic sunroof shattering issue?
Yes. The Song-Beverly Act covers any defect that substantially impairs the use, value, or safety of the vehicle. A spontaneously shattering panoramic sunroof is both a safety hazard and a substantial impairment of value. If the manufacturer cannot provide a permanent repair, you may be entitled to a buyback or replacement under the Act.
