I bought my Outlander PHEV partly for the California HOV lane sticker. If it is a lemon, do I get reimbursed for the premium I paid?
Under Song-Beverly, your refund includes the full purchase price and collateral charges. The premium you paid for a PHEV over a standard model is inherently part of the purchase price and would be included. Additionally, any registration fees, sales tax, and incidental costs related to the purchase are also recoverable in your lemon law claim.
Can Mitsubishi require me to wait for a software update to fix the hybrid system before my Lemon Law claim proceeds?
No. While Mitsubishi may offer a software update as a repair attempt, the Song-Beverly Act does not require you to wait indefinitely for a fix. If the manufacturer has already had a reasonable number of repair attempts or the vehicle has been out of service for 30 or more days, you are entitled to pursue your claim regardless of promised future fixes.
