Parts unavailability does not excuse the manufacturer from its warranty obligations under Song-Beverly. What if Polestar argues the O2 Concept's quirks are inherent to its concept-derived design?

Design-inherent characteristics that substantially impair the use, value, or safety of the vehicle are still defects under the Song-Beverly Act. A manufacturer cannot avoid liability by claiming a problem is a design feature when it prevents the vehicle from functioning safely and reliably as a consumer would reasonably expect.

While the Song-Beverly Act does not specifically mandate loaner vehicles, many manufacturer warranty programs include transportation provisions.
