My 718 Boxster's convertible top stopped working and has been at the dealer for three weeks waiting for parts. Does waiting for parts count toward the 30-day lemon law limit?

Yes. Under the Song-Beverly Act, every calendar day that your 718 Boxster is out of service for warranty repair counts toward the 30-day threshold, including days the dealer is waiting for parts from Porsche. You do not need to prove the delay was unreasonable. Request a loaner vehicle and document the drop-off and pickup dates on each repair order.

The dealer says my 718 Boxster's wastegate rattle is a known characteristic and not a defect. How do I challenge this?

A known issue is not the same as an acceptable characteristic. If Porsche has issued a technical service bulletin addressing the wastegate rattle, that is evidence the manufacturer acknowledges it as a defect. Under the Song-Beverly Act, the manufacturer must repair any defect covered by the warranty. Obtain a copy of any relevant TSBs and include them in your lemon law demand.

I only drive my 718 Boxster on weekends and it has low mileage. Does that weaken my California lemon law case?

Low mileage actually strengthens your claim because the mileage offset deducted from your refund under the Song-Beverly Act will be smaller. The offset is calculated by dividing the purchase price by 120,000 and multiplying by the miles driven before the first repair attempt. Weekend-only use also demonstrates that the defect occurred under normal driving conditions.

Can I get Porsche to pay for a rental car while my 718 Boxster is being repaired under warranty?

The Song-Beverly Act entitles you to recover incidental damages, which can include rental car costs incurred while your vehicle is in for warranty repair. Keep all rental receipts and make sure they reflect a comparable or lesser vehicle class. These costs are recoverable as part of a lemon law buyback or can be demanded separately if the repairs are eventually successful.
