If the dealer has attempted to remedy the issue through software updates or piston ring replacement without success, you may be entitled to a buyback or replacement.
Porsche offered me a goodwill repair on my 911's PDK transmission instead of a warranty claim. Does this affect my lemon law rights?
Accepting a goodwill repair does not waive your rights under the Song-Beverly Act. Each repair attempt, whether performed under warranty or goodwill, counts toward the reasonable number of attempts the manufacturer is afforded. Ensure the repair order clearly describes the defect and the work performed regardless of how it is billed.
Can I claim diminished value on my 911 in addition to a lemon law buyback in California?
Under the Song-Beverly Act, you are entitled to a refund of the purchase price minus a reasonable offset for mileage used before the first repair attempt. California courts have also awarded civil penalties of up to two times the actual damages if the manufacturer willfully violated the Act. Diminished value claims may be pursued separately under general civil remedies.
My 911 has been at the Porsche dealer for over 30 days for a front axle lift system repair. What should I do?
Under California's Song-Beverly Act, a vehicle that has been out of service for 30 or more cumulative calendar days due to warranty repairs creates a presumption that the vehicle is a lemon.
