Rolls-Royce Dawn Lemon Law FAQ
The soft top on my Rolls-Royce Dawn is deteriorating prematurely. Is this covered by the Lemon Law?
Premature deterioration of the convertible top on a Dawn can be a substantial defect under the Song-Beverly Act, as it impairs both the use and value of the vehicle. If the top is failing within the warranty period and the dealer cannot adequately repair or replace it, you may have a valid lemon law claim.
My Dawn's roof gets stuck while opening. How many times does the dealer need to try fixing it?
Under the Song-Beverly Act, four repair attempts for the same non-safety defect generally creates a presumption that the vehicle is a lemon. However, if the roof malfunction creates a safety concern, such as being stuck open during inclement weather, two attempts may be sufficient. Each failed attempt should be documented on a repair order.
Can I get a civil penalty in addition to a refund for my Dawn under the Lemon Law?
Yes. Under the Song-Beverly Act, if the manufacturer willfully failed to comply with its obligations, you may be entitled to a civil penalty of up to two times the actual damages. If Rolls-Royce knew your Dawn had a substantial defect and refused to repurchase it, a court may award this additional penalty.
I reported the defect to my Rolls-Royce dealer but they have no record. What should I do?
Missing dealer records can complicate but do not necessarily defeat your lemon law claim. Gather any personal records such as text messages, emails, calendar entries, or credit card receipts showing you visited the dealer. Under the Song-Beverly Act, your testimony and circumstantial evidence can help establish the repair history even without official dealer records.
