Toyota Prius Lemon Law FAQ
My Prius hybrid battery is failing prematurely. Does California's extended hybrid warranty help my Lemon Law claim?
Yes. California CARB regulations require Toyota to warranty hybrid battery packs for 10 years or 150,000 miles. If your Prius hybrid battery fails within this period and Toyota cannot repair or replace it successfully, the Song-Beverly Act entitles you to a buyback or replacement. A premature battery failure at 80,000 miles is well within the warranty and strongly supports a Lemon Law claim.
Can I file a Lemon Law claim for my Prius's poor fuel economy caused by the EGR valve issue?
If the clogged EGR system causes your Prius to fall significantly below its EPA-rated fuel economy and Toyota cannot fix the problem despite reasonable repair attempts, this constitutes a substantial impairment of the vehicle's value under the Song-Beverly Act. The Prius is marketed primarily for its fuel efficiency, so any defect that meaningfully reduces MPG undermines the core value proposition of the vehicle.
My Prius inverter failed and left me stranded on the freeway. What should I do first?
First, ensure your safety and have the vehicle towed to an authorized Toyota dealer. Request a detailed repair order that documents the inverter failure, all diagnostic trouble codes, and the circumstances of the breakdown. File a complaint with NHTSA at safercar.gov. Under the Song-Beverly Act, an inverter failure causing sudden loss of power on a freeway is a serious safety defect that may require only two repair attempts before Lemon Law relief applies.
Does the new 2023-2024 Prius brake rotor warping issue qualify under Lemon Law even though brakes are wear items?
While brake pads are considered wear items, brake rotors warping at 10,000-15,000 miles is a manufacturing or design defect, not normal wear. Under the Song-Beverly Act, premature brake rotor failure on a new vehicle covered by the basic warranty is a warrantable defect. If Toyota has resurfaced or replaced the rotors and the warping recurs, each repair attempt counts toward your Lemon Law threshold.
